Can investigation officer return documents to accused?

My query is pertaining to a criminal case relating to fraudulent take over of a company which was refered by the police(CB CID) as civil dispute. IO in his closure report before Court talks about several docuemtns like Minutes, Notices (copies only) etc. However when the same was requested under RTI Act for filing a protest complainant, the reply given was that all was returned to accused under the pretext that same was under use by the company....

My queries are.....

1. Can IO return this documents/evidence base don which he has filed the closure report....even without keeping a copy of the same

2. If so what is the procedure for returning the same(Like request, documentation reason for returning the same etc)

An other information on the subject matter is welcomed....

Your focus should be objecting to the closure report, if you feel that the the said report is improper. The required documents could be accessed through the court.
