payment fraud

I gave 90000 to someone in his bank A/c , through neft and imps transfer mode, I don't have his cheque, he is denying for repayment, how to file case against him.

Dear sir,

You should have documents that you have given loan for legal action. Try to get cheque and loan documents signed from him.

Not repaying money borrowed itself is not a fraud and contact a local advocate and maintain cordial relations with your friends  till you have such documents required by your advocate for further action against your friend.  Have patience and proceed legally.  Treating the amount as lost, you can fight for further remedy if mutual friends fail to help you in recovery.

1. You can file a Police FIR, requesting investigation and charge-sheet, for offences like cheating, intimidation, fraud, breach of trust etc.... against the person, supported with all relevant supporting Documents & Witnesses.

2.  IF the Police does not take action, THEN you can file private criminal case u/s 156(3) Cr.P.C., in the local Magistrates court, seeking directions to the Police to investigate and file charge sheet.  The said Person may come down for settlement.

You first issue a legal demand notice based on the evidence of bank transaction.

If he fails to comply with the demands made then you may file a money recovery suit.
