workplace humiliation and raging by my boss

My friend is clerk in a government department and his boss frequently humiliate him by target his personal issues and comments on his wife age as she is elder than him. He also talks with him irrespectfully.

Please suggest

Try to get visual evidence(like CCTV,mobile vid+aud)

then complain to the Board of the dept./Area heead

But keep in mind that evidence need to be so perfect,otherwise they target him more...so take steps wisely.

There is no derth of sick people in this world who just basher their frustations on others and make them feel uncomfortble. Just have patience and wait for the right oppurtunity to hit back,,

There is no remedy for such incidents as these incidents are very common and there is no dearth of such inhuman idiots in India.  Any retaliation may bring more complications to your friend and particularly due to the innocent involvement of other friends for him.  Government servants have associations/unions and they can handle such errant superiors in a better way.

Why are you perturbed for the incident of your friend or his wife ?

If there is something against you it would be appropriate to consult a local prudent lawyer for better appreciation of facts / documents, professional guidance and proceeding.

To report any case or incident, getting as many facts ready as possible is important. These are required to verify and authenticate your complaint as well as to ensure that the harasser knows the type of behaviour that has caused the complaint to take place. There might be witnesses who were present during the incident. If it was harassment via an online medium, there are snapshots that can be shared. Time and place of the incident are also critical to the complaint.

Relevant Provisions

  • Misconducts under the Standing Orders.
  • If specific acts not listed as misconduct under standing orders, clause pertaining to act subversive of discipline and good behavior on the premises of the establishment
  • Unfair labour practice under Industrial Disputes Act 1947
  • Relevant Provision of Indian Penal Code - 1860

You may file complaint in relevant provissions in portal of ministry of labor.

If the siotuation becomes intolerable then you may plan to give a complaint against him to the higher authorities by collecting evidence against him.

If there is no proper action by the higher authorities against him despite you had given complaint with evidences, then you can plan to initiate steps to tackle it legally, however you may make sure that this action do not ruin your employment  career
