You can file a suit for recovery of money in the district court having territorial jurisdiction over your area and you shall state the amount precisely in the plaint.

Dr J C Vashista (Advocate)     09 May 2020

Institute a suit for recovery of cheque amount under the provisions of Order XXXVII Rules 1 & 2 of the Code of Civil Procedure, 1908., if the cheque was drawn within 3 years.

1. Expired Date cheque CANNOT be used for any purposes, except as documentary evidence in a duly filed "Recovery Suit" in the local Civil Court, which can be filed for "previous dues"

It will be hit by limitation and the court may conode such delay subject to proof of sufficient reason and it is discretion of the court.

Your case is hopelessly time-barred.

AND did you mention this in your first original post ????

Send the cheque to dustbin for final disposal and get rid of unnecessary tension with the view that you are holding a 10 years old cheque.
