Action, against a limited company, for non-payment of due amount to its transporter

Sir/Madam,

What are the options available to me as legal action against a limited company for non-payment of due amount to the transporter??

Also, can i charge an amount of interest on such due amount of transporter, if such transporter has taken a business loan for funds required for its business, due to such blocking of funds of transporter by such limited company??? If so, then at what percentage shall such interest be charged???

Also, is there any way out through which i can establish a pressure on such limited company to immediately pay such due amount for bills of the transporter???

PLEASE GUIDE ME.......

Use civil recovery to establish your dues,and then file execution of such recovery decision , if company remain fail to pay your dues, then u can file winding up.

Sir, can I file directly the winding up petition or rather it is necessitated to firstly, file a civil suit against company for my dues & only than I could be able to file such winding up petition...

Also, if I file a civil suit then does such case cover under any specific provision of law, under which I could get my dues cleared on EARLIER BASIS...Further, is there any time limit mentioned under which I could get a decision of honorable law court...

Please guide me.......

after issue of legal notice file winding up petition . you can file civil recovery suit within period of 3 years

Under all such circumstances, first a legal notice giving full details and demanding the amount involved whether with or without interest is to be issued and upon his reply next legal course of action as advised may be initiated if there arises a necessity.
