I have a flat in a building at Chandivali, Mumbai. We are 3 co-owners to this flat i:e myself, my wife and my younger brother respectively.
This flat was purchased from a developer in the year 1994.
The entire cost of the flat was borne by me only.
Presently my brother is residing in the United States of America as a NRI.
Now we intend to sell this flat. My brother will not be able to come to India to execute the sale deed in time. In this circumstance what is the best possible document that I will have to get prepared (like gift deed, POA, etc), so that we can sell the flat and execute the sale deed in his absence.
What will be the stamp duty and registration charges of such document? And what is the procedure to be followed?

Under the above circumstances, it is better that you get a power of attorney deed in your favor subsequent to which you can sell the property on behalf of your brother too based on the POA deed. The stamp duty clarification may be had from local SRO.
