Purchase of land by husband and wife jointly

Dear friends,

I have a query,

A husband and a wife purchased a land jointly in Gujarat. Husband is a agriculturist by birth. Wife is not an agriculturist by birth. Whether there is any breach under section 63 of the Bombay Tenancy and Agricultural Land Act. Definition of a person as per the Act includes Joint Family. Please provide citations of Gujarat High Court or Supreme Court in the matter.
