Judiciary and foreign tours

Dear Sir, 

Welcome district judiciary.

It is learnt that the Union government had sanctioned about 15 crores of rupees for foreign tour to know about the functioning of judiciary in few foreign countries. It was further learnt that some judges of the higher judiciary had made a plan to visit foreign countries at government expenses. Alas! It could not be matured as the Union government told that the funds are meant for district judiciary only. This is really luck of district judiciary. Otherwise they have to accept bits and crumbs of higher judiciary. Used cars etc. are one of the best examples.

If judges of the district judiciary have their god fathers and god mothers they can rush for their names to be recommended for such tours. Judges who have no pass ports should get prepared without delay as Modi government has directed that in preparation of pass ports there should be no delay.

Go on pursuing to show that how one is 'the best person' whom high court should recommend the concerning government for sending the recommended judges on foreign tour. 

In fact it is immaterial who goes to foreign tours. In India there is vast scope to learn how to work and how to manage judicial work and administration.  In reality it appears that the general opinion of the advocates and general public is that higher judiciary has dominated the subordinate judiciary and does not allow working independently.  Come sit and discuss problems with advocates and public; one will be able to know how cumbersome procedure has been adopted in high courts. For high courts it is rituals which are more important rather than real work to be done. A trial courts hardly takes 15-20 days to decide an application for amendment or an application for bringing legal representatives on recordybut in high courts because of so called ritualistic attitude it takes months together to decide such applications.

For judicial management and administration no foreign tours at any level are necessary. What is required is attitude of judges to devote themselves for justice at every cost. Karma that is duty with devotion is the key to have justice system successful. Go to some persons who have worked on grass rout or come to me that too without any cost! I will let others know! To save   public money should be the primary object. Let the Chief Justice of India in the auspices of the President of India start a Swachha Nayaypalika Abhiyan and make the subordinate judiciary a strong judiciary and try to see that its independence is restored back.  Eradicate and clean the Indian judiciary at every level in the hierarchy from corruption and mal practices including judicial rituals. Giving guidance is thousand times better than giving sermons. It is always better that elderly judges lay examples rather than finding faults.

The fault with judiciary is judges are weak in civil and criminal procedure codes, lack of proper training and faulty system of recruitment to lower judiciary. Unwanted emphasis is placed on unwanted subjects and topics in departmental examinations and recruitment also.

It is the duty of the higher judiciary that proper moral support and supporting hand should be extends towards subordinate judiciary to improve its standard both in disposal of cases by deciding in right manner and to maintain the quality of work. Hope this may be a heedful word to persons in authority.
