138 n i act - limitation for filing complaint

For for a complaint un 138 N I Act against returned cheques - which date is counted for filing the complaint under time limitation? Date of Filing the Complaint or Date of SR as per the court records?

Within one month from the date of rejection of cheque,,a legal,notice has to be sent to pay the money within 15 days. After the expiry of 15 days period, a case has to be filed within one month
