I have a filed plaint at Lower Court ( Munisif) and same was numbered and now it is for WS, defendant failed to file WS, so Hon'ble Court set exparte. Thereafter Counsel for Defendants filed WS with set aside petition adn took ground of pecuinary jurisdiction.
We verified that at in the value of suit Rs.20,000/- is excess so beyond the jurisdiction have by this court.
So we filed MEMO for return of plaint and seek transfer the case to present at proper court.
It happaned due to oversight, recently state government has enhanced the lower court limitation under impressin it was filed.
What are the remedies ?
