Dear

It is not u or me can execute an arbitration award. As per the agreement bewteen two parties if arbitration clause is there for the adjudication of any dispute then arbitrator will be appoited by the parties or by ICA or any named arbitrator as per the caluse. Accordingly the party ha wants to raise calim will file claim before the arbitrator and other reply and matter will proceed for trial of the dispute. After coming to the conclusion arbitrator will pass the award.

In lay man language "award of the arbitrator" is a "order of the judge".Also i would like to clear that "Arbitrator" is a judge appointed with consent by both parties to the dispute.

An Arbitral award shall be enforced in the same manner as if it were a decree of the Court and hence the CPC should be followed in enforcing the same. A move to enforce an arbitral award shall be made as soon as the time for making an application to set aside the award u/s 34 has expired(3months + 30 days), or if such application has been made but the same has been refused.
