Bad news for indian husbands.

A bunch of petitions was filed in the Supreme Court challenging adultery law calling it anti-men. Hearing the petitioners, the Supreme Court has observed that the IPC Section 497 is actually anti-women.

 

The Supreme Court has said that the adultery related provisions in the Indian Penal Code (IPC) is anti-women and archaic. A five-judge constitution bench headed by Chief Justice Dipak Misra made the observation on the second day of hearing on a bunch of petitions seeking quashing of IPC Section 497.

The petitioners challenged the adultery law saying that it violates the right to equality guaranteed by Article 14 of the Constitution. They argued that the adultery law only punished married men for having extra-marital s*xual relations with a married woman.

Hearing the petitioners, the Supreme Court today, August 2, said, "The law seems to be pro-women but is anti-women in a grave ostensible way. As if with the consent of the husband wife can be subjected to someone else's desire. That's not Indian morality."

IPC Section 497 states, : "Whoever has s*xual intercourse with a person who is and whom he knows or has reason to believe to be the wife of another man, without the consent or connivance of that man, such s*xual intercourse not amounting to the offence of rape, is guilty of the offence of adultery."

"Each partner of the marriage has equal responsibility. Why should woman take more load than the man? That is the reason we call it archaic," the Supreme Court said.

The Supreme Court yesterday, August 1, commenced hearing on the pleas.

On the one hand the Hon Supreme Court wants to save the Indian Family and on the other hand the above view observed by Shri Dipak Mishra quite opposite.

What impact will it have on the Indian Husband only time will tell.  Is it so that just because Judges have protection through Law, the Judge did not think anything about the Indian Husband who is not a Supreme Court Judge like him?

How come its a BAD news? De-criminalizing adultery is good right isn't it?? As such extra marital affairs are very very common these days and times changed, there days there are no Sita's in wife's and at the same time there are no Rama's in husband's so this will be good time to de-criminalize adultery.

as such adultery is also a ground for divorce so no change in those fronts, so how will de-criminalizing of adultery a BAD NEWS??

not sure how you both concluded on what basis you are telling this a bad news?

There are societies such as Taliban ..who kill the women who have extramarital physical intimacy with other men.....and then, there are societies such as USA and Europe where EMR has no legal consequences except possible divorce.

The criminalization of adultery originates from primitive ,archaic belief that woman is property of man...just like goat or cow and the man will decide who she loves or be physically close as the man owns her.  

But, if you believe in equality of gender and mutual respect...Adultery must not be considered a crime.  The fundamental question is ...who the body of a woman belongs to..To her? To her husband? To a mullah or priest? To government ?  Answer is simple..body of a woman (or a man) belongs to herself.  Therefore, who she allows to enjoy it..should be decided only by her/him.   Remember, Attempting suicide was a crime in India until 2 years ago.  As we has more knowledge of human mind and behavior, we removed suicide attempt from list of crimes.

As for Indian Morality...there is no special Indian morality....Indians are as corrupt or immoral as any other country .  An evolved society gives an individual right to live and love as that individual think fit. 

Its time to de-crimilinize adultery and set people free and remove the chains of husbands or govt or priests.  A person own her/his body...a woman's body belongs to that woman....because she is a living, thinking, feeling person and not a buffalo or goat.

Gender equality is sign of a developed civilization and let India move towards a developed nation status.

By the way, this bad news for Indian husbands will only make them better in future...they will become more loving, more caring, more respecctful and better in bed.  So, its a good news for all.  Just be better lovers..my dear Indian Hubbys.!!! There will be competition of love.

Relationships are to make the partners life easy and happier....not to control, intimidate, threaten and cause unhappiness.
