Being Late

NAGPUR: Coming just three minutes late when his boss had called him almost ruined the career of a senior PA (personal assistant) of a judge in Bombay High Court here. Senior PA to a judge Kishor Jeswani had to tender unconditional apology to the court on Tuesday to save himself. The courtwarned Jeswani against repeating the mistake and discharged the contempt proceedings initiated against him for coming late. The incident happened on Friday when a division bench comprising justices Ambadas Joshi and Prasanna Varale had called Jeswani for a dictation as their regular stenographer was on leave. The judges sent chopdar (court attendant) Mouji Bhange to call Jeswani. Jeswani, who was reportedly busy, told Bhange that he would be reaching the court in a few minutes. But what Bhange told the judges apparently angered them. When Jeswani reached the court just three minutes late, he was given a sound warning by the bench initially. On Monday, the bench initiated contempt proceedings against him for coming late. When Jeswani came to know about it, he immediately drafted a three-page reply along with an apology and rushed to the court to submit them. However, the court blasted him in some terse words for his attitude. Jeswani was told to take official leave on Tuesday to file a detailed reply. On Tuesday, during hearing of contempt proceedings, the court first fired Chopdar Bhange for twisting the message of Jeswani while narrating it to the court. Jeswani, who is on the verge of retirement, was initially handed two weeks' suspension. However, after tendering apology and considering his unblemished past record, the suspension was revoked.

The incedence reminds me of a science fiction  by jules verne "Round the world in 80 days"

In it there is a character namely Phileas Fogg who has dismissed his servant for bringing his shaving water below the temperature of 2 or 3 degree fahrenheat from the usual 86degree fahrenheat or so.

unbelievable incident.

if the same thing was done by politician then there will be lot of hue and cry against him.

in this matter, the PA is an aged person who is going to retire in couple of weeks and hence it may take time for him to reach the court. It is highly unfortunate incident.

So no Judge should be allowed to decide the case (contempt of court case) where he is a party.  No one can expect  impartial or unbiased verdict in such cases.  Only on the basis word of chopdar  (who may behave like superior to others as he is always with the Judge), how one can try to spoil anybody's life.  It means every one has to follow chopdar's order without delay ,even if he is engaged in a legal duty.  And oral instructions of chopdar may get more weightage than written office order by other higher officers. On this issue I have one quote of a Judge ;  “We are not final because we are infallible, but we are infallible only

because we are final". ( I don't recollect the name ..but I have read it somewhere and noted in the diary)
