Builder agreement on leasehold prop- clarification required

We plan to buy a commercial flat (in a leasehold commercial complex) in Delhi. We are told that a transfer fees needs to be paid to the builder and the builder agreement will be endorsed in our favor. The building is about 20 years old and the flat has changed at least 3-4 hands in the same way.

 

Is it a legal way to transfer the property? Keeping in mind the notification issued by the Supreme Court of India on 14 October 2011 (that SA / GPA / Will transactions not valid), what will be the status of such a transfer?
