I have bought a Flat from a builder in Hyderabad. It is part of a gated community. During the sale, he mentioned that Club house within the gated community will be owned by the Owner's Association and the ownership will be trasferred to association when it is formed.
But in the sale deed, he has avoided giving the exact text which clearly defines the ownership of Association which is built inside the gated community.
Builder has also put a clause in the sale deed to keep maintenance of the property with him and abide the terms of that agreement.
We have approched the Builder to change these points from the sale deed, but he is not ready to change and giving some bogus reasons saying it will take long time to sale deed. etc
We have not registered the sale deeds yet because of these issues.
What are our options?
How can we make sure that our interests are protected?
e.g. Club house ownership should be with association,
Also, association should be free to choose any vendor based on total maintenace package and builder should not exclusively have maintainance contract.
