Coustody of minor

In case of death of father and mother who will be the natural guardian. If -

1. paternal grandfather age above 60 yrs not in good health and paternal grandmother is not alive.

Where As

2. Maternal grandfather and Grandmother are alive and in good health.

and child is less than 4 yrs.

The guardian court is entrusted with this responsibility to decide in favour of the welfare of the child. There would not be a natural gaurdian in such a situation, it would be for the Guardian Judge to take suitable measure for ensuring the safe bringing up of the minor.

According to geneology the father's side parents will take the priority. But in case of dispute then the case is to be decided under Guardians and Wards ACt. Who is the District Judge concenred.
