Death declaration

If a person was missing from last 7 years n police give report of no found the missing person. What have to do ?

Presumption of death is governed by sections 107 and 108 of the Evidence Act, which allows for presumption of death for a person missing for 7 years to be raised in appropriate proceedings before the court. you may file application along with reports

You have to file suit for declaration before civil court in regards to death of that person on ground of that person is missing from more than seven years so it may be presumed and declared him dead.

1.  There lots of legal proceedings to be conducted and such procedures depends on what is intended to be done, for futuristic legal requirements.

After getting the report from the Police, you have to file a declaration suit with a copy of the report given by the police concerned.
