Discharge U/s 239 CrPC

Dear All,

 

Who are the respondent to be shown in the dischage application U/s 239 CrPC in 498A IPC case ....

There will be only one respondent that is State or need to put complainant as respondent ...?

As the crime is percieved to be committed against the society at large, the defacto complainant is represented in the court of law by the State through Public Prosecutor and hence in such application the opposite party is to mentioned is State and not the de facto complainant.
