Ecommerce fraud

Sold item on ecommerce website,  shipped item by reputed courier, buyer is saying that he has not received the item and he doesn't know any person of that name who signed the proof of delivery.Courier guy sent mail confirming delivery of item but buyer is not ready to talk with this courier guy. If I decide to go for legal action for this so called "stolen item", how should I start, What all options do I have?

ASk the delivery boy to call from his number and the recipient's number and record the call.

Then apply his own wisdom and have a meeting and record (audio/visual) along with two witnesses and let him accept on dated he in response to call sent his friend and has already recived the consignment.

Close the matter by local wisdom and resources.

Courier is otherwise a party to the matter and has to establish that item was delivered.

Thanks for your reply.

Will it come under cyber crime?

It comes under the law of torts as a fraud.

All such companies record business calls.

Any evidence even if acquired by illegal means remains evidence.

Online discussions have its own limitations.

Discuss the matter in person with your able lawyer and defend your interest in the best possible manner.

Wish you the best.
