Fake promise on marriage for money

Dear Sir/Madam,

I'm an NRI and met a girl in a matrimony site back in 2013 and they accepted. Later her parents were hesitant since I'm Tamil and they are Mallus She was interested in me, and she wanted to do IAS, but couldnt afford IAS training. So I offered help and she went for training. spent almost 9 lakhs on her, including training. Her parents didnt know our affair. After 2 years I met her dad and spoke, and he wanted me to wait for 6 months to confirm the proposal. After 2 months, Due to a quarrel with her, I told her dad about my help to her, then seems he scolded her and she stopped talking. After that, he understood that I was genuine/fool, but then started telling his problem and I had to rescue. Later he started lying like he has this that problem and keep talking money. every time he promised I'll speak to your parents once this problem is solved and will get her married. He dragged for 2.5 years and took 10 lakhs in total. Now she didnt speak to me for 2.5 years and almost 5 years gone. Now they say she's making final attempt for IAS and will only get married by end of 2018. They dont want to do even engagement until then and no guarantee. I had hope only bcoz her dad promised me the marriage for this year, now backed out and says wait till next year end, but I cant trust them anymore. I'm 33 now and she is 31.

I dont want to proceed further. How do I recover my money 19 lakhs. I have call recordings with her dad for only for last couple of months, and transferred money to both thru Banks and exchanges. Out of frustration on these years I used some bad words when asking my money in the email since she completely stopped talking and changed the number. Will it be a problem for me.

Any help would be greatly appreciated.

Limitation for filing a recovery suit is 3 years from the date of payment. Fresh limitation starts from the date of last acknowledgement.

Each and every penny can be recovered. In fact their property can be attached.

Putative method for these type of cases are
Under Order 37 - Summary Suit - The Code of Civil Procedure 1908

I can understand your frustration.
If you are still loving her. Try to sit together and reconcile. Maybe she doesn't want to distract her mind away from the target.
You can recover your money, but there may be a peril of missing her in your life forever.

Sir, Thank you so much for your response! I gave the amount since she showed interest in me, and also to her dad. It was like small chunks of money like 1-3 lakhs and some gifts totaling 19 lakhs over the period of 5 years. Does it mean I cannot recover the money given 3 years ago. Problem is they dont even want to do engagement  and its been 5 years, not even ready to share the address for my family to visit them. So I lost my trust in them completely. Per her dad, after her last year 2016 attempt this year was supposed to marry irrespective of her result, and that's why i waited for all these years trusting him. I'm in trmendous pressure from all sides and stressed. I'm saying it simply, but its like unexplainable pain and had so many health issues due to stress and many sleepless nights.

There is no extortion and there is no promise on repayment of money.  You have willingly, voluntarily spent with expectations and taken your discretion, being NRI to fight out case in India is not as simple as you perceive with such call recordings and without any legal documents. In India, advocates are experts even in turning tables against you, saying that it is you that spread the net to impress her, and spent on your own.  Be cautious while taking a decision.

Mr Krishnan,

 

Order 37 CPC is not applicable on whatever you have stated. If you have any written stuff with her or with her father that you are giving so and so money as loan etc, then you can make some attempt otherwise please take your time and see if it is worth pursuing.

Sorry..It's like... f*k you asshl... You the f*king asshl where u hiding. every day i emailed her to call me and several times asked in email to return the money and respond to my emails, but not a single email or call.... I was so frustrated and used those words at times.

Thank you very much for your response!

When i gave the money she said she'd start repaying after ias training and returning to work...back in 2014. After that she worked till 2015 December but not returned a penny. Then she moved to Delhi for training again and till now she's there. I gave the money to her dad since he said he took money from local guy giving a dated check. And if he don't return it he might deposit check and end up facing charges. So i gave him money and he promised to return within 6 months, but this wasn't recorded. Then his mom was hospitalized then passed away so i had to help him on all that. He kept telling problem and took money and promised he will arrange the marriage once this problem is solved. Only earlier this year even after her result was out and she didn't clear this time, he changed his words according to her tune and asked to wait for another 2 years without any formal confirmation with families. And whatever he was telling most of them were lies just for money..i figured out on one occasion and then started recording calls.

Civil recovery suit for the amount given to the person may take number of years and the recoveries of the same full in principle leave aside the interest is very bleak. You may have to engage local lawyer who will be charging his professional fees. The litigation continues from the trail court till the Supreme Court of India the final destination. rest assure after filling suit for recovery of your money next 10 years and the same amount you seek to recover will be spent in litigation.

Most important, you lend her the amount not on any agreement to be paid back by her in future as loan, but merely on the basis of love and affection towards her as you wanted to marry her, this will be taken by the opposite party as in their defense and stated as gift given to her which becomes her exclusive property that you cannot ask her back.

Few things are best avoided; one is to avoid to lend money.

You may take up the matter with a LOCAL counsel and understand the merits, costs, litigation,Fees, time etc  and decide.

Thank you for your answer! I didnt give money as gift. She told she will return once returned to work in 2014 itself. And I do have whatspp chat copy where she mentioned I will return all the money borrowed from you without keeping a penny. I gave the money since they showed interest in me, now when its obvious that that's not their real intention now, is it not an offense in our law? Is it not breach of trust? Does law wont help to recover the money in this case?
