Thanks for your reply, my doubt is whether my working period as Temp Staff for 4 months can be considered for caculation of gratuity after my completion of 5 years ?

I have been employed as Temp Staff  from 05/03/2007 in accounts department for 4 months (not included in Payroll) & next 4 months worked as UnConfirmed staff (Included In Payroll).

Now my joining date as Temp staff  i.e 05/03/2007 is applicable to calculate gratuity ?

YES, YOUR WORKING PERIOD AS TEMP. STAFF AND ALSO AS UN CONFIRMED STAFF WILL BE CALCULATED FOR THE PURPOSE OF CONTINUOUS SERVICE AS DEFINED IN SECTION 2A OF THE ACT.
