A case was filed in consumer forum without making party patnership firm & co. by its legal advisor filing vakalth depositors of firm/co making number of opposite parties. Due neglence of other OPs one OP appeared before court and the court order in favour of complainant. Even then other ops did not turn up. Complainant/DHr filed EP against one OP. The forum allowed the EP.
My question is
1. When there are number of opposite parties in the complaint and ordered against all jointly & severally can DHr file EP against only one OP?
2. Here non-joinder of other JDrs. applicable or not?
3. Whether ancestor property be attached when it no way related to firm or co.
4. How can I proceed?
