How can i buy a terrace flat?

I need your views on the below situation:

1) The building is very old - constructed in 1970 - in mumbai. The building is not a society and is individual ownership.

2) The agreements of all the occupants states that they have no right over the terrace of the said building . The agreement also clearly states that the buyer will agree to the maharashtra ownership flats act.

3) There are two rooms attached to the terrace - and there is a door from the two rooms that opens into the terrace.

4) The builder has sold the terrace to the flat owner of the topmost flat. 

Can the other occupants - after signing the agreement that they will not have any claim to the terrace - start demanding the same?

Please read carefully and advise - as this is not a society - has close to 6 apartments.
