Legal position during "NO Leave and License agreement period

 

Hi!

What will be the legal position in the following case? :

The Original Leave and Licence agreement of 11 months has expired BUT still the licensee is allowed to occupy the property for another 11 months without any renewal of the Original agreement.

However, the Licensor and the Licensee intend to make a New Leave and License agreement for a period of 2 years after the expiry of the "no agreement period".

In case of new agreement licensee will be continued.  If it is expired also he will be thelicensee, the meaning of leave and license is that  whenever licensor asked the licensee to leave the house he will have leave it.

Let me quote an example of the Question raised by me:

Say the Original agreement is from 01/07/2009 to 31/05/2010.

The Original agreement has not been renewed. BUT still the licensee is allowed to occupy the property from 01/06/2010 to 30/04/2011 without any renewal of the Original agreement.

Now, the licensor and the licensee intend to make a New Leave and License agreement for a period of 2 years from 01/05/2011 to 30/04/2013.

WHAT would be the legal effect in the above scenario??
