mohamaddan law

In a Mohammedan family the possession of a brother should be deemed to be the possession of the other co-sharers unless the Co-sharer in possession (brother) repudiates the right in himself. In
Mohammedan Law the possession of one Co-sharer would be regarded on behalf of the other Co-sharers unless there is anything which amounts to the ouster of the Co-sharer

That is not in Muslim law but as generle rule - Possession of joint property by one co-owner is in the eye of law, possession of all even if all but one are actually out of possession. That is defined in a supreme court judment- Jai Singh and Ors. …. Versus Gurmej Singh- SC 2007
