Ou/fatherrs is a small family; father, mother, two brothers and me, the sister. My father died a few years ago leaving a Will, bequething the property disproportionately amomg us, i.e., my brothers and me. my mother does not have any share in the property, but can enjoy the income from the property.
The property is inheritted from my grand mother/ father. My mother is the custodian of the property without any legal right, as per the Will, to sell or mortgage or dispose off it in any manner, till her death. In short she cannot sell the property or become a party to sell it.
Recently, one of my brothers transferred / registered his share of the proerty in his name. This property, i.e. his share of the property, was sold subsequently, without any consent letter from me and my other brother. We came to know the sale, after some months. My question is whether, my brother can sell the property without a consent letter from us. If the answer is no, then what will be legal stand, whether the deal could be legally declared null and void and what are the consequences the buyer will have to face, if he wants to sell it.
