Query

What is civil and criminal liability under the Trade Union Act?

1) Can the registered Trade union will be held responsible both (civil and criminal) for the acts done by them, or by their office bearers?

2) Will they get immunity for the acts done by them because of the fact that their union is registered?

See section 17 and 18 if the Indian Trade Unions act 1926, and read it with Rhotas Indutries Staff Union Vs State of Bihar AIR 1963 Patna 170.

Thank you sir for throwing some light on this topic

The case you mentioned talks about civil immunity for the registered trade union. But if the union or its members does any criminal act; then also will they get proctection by virtue of section 17 of trade union act?
