REGARDING GPA

Hi,

My father owns a flat in vishakhapatnam. I have one elder sister and have no brothers. In 2008, my father wanted to sell that flat and at that time we(myself and my husband) thought of buying it. And we paid the money for that flat to our parents. But we didn't register that flat in our name.  We thought of taking GPA for that flat. My mother and my sister also know that we gave the money for that flat. Suddenly my father has expired last year. Now can you please let me know the procedure for taking GPA/ registering the flat in my name. My mother and my sister have no problem and they are ready to sign where ever it is needed. The flat is registered in the name of our father. We got a leagal heir certificate in the name of our mother.

As legal heirs of your late father, your sister and mother can jointly execute the sale deed in your favour. However a copy of the death certificate and legal heirs certificate should be enclosed along with the sale deed at the time of registration.

After the death of your father, you, your sister and mother became the joint owners of the property.

Instead of sale deed, you can ask your mother and ur sister to execute RELEASE DEED in your favour.

This is simple and can avoid stamp duty.
