Hi Sir/Mam,
My father has bought a property from my two uncle on 1993 he has entered a sale agreement for Rs 200000 which was not registered, and paid a amount of Rs 150000 and registered a GPOA on the same day to sell or mortgage the property and we got possesion to the property and stayed in the property in the year June 2009, with the GPOA my father transferred the property in my name by a sale deed for Rs 2100000 and I paid 9% registration charges and got the document registered in my name. Now all revenue records, patta etc alies in my name. In Jan 2012 we applied for construction of my house to the corportation and got approved and started constructing our house. Now both my uncles says they would get injunction and stop our work and ask us to pay a huge amount, present market value of the property.
We had sent a Caveat petition for 90 days to both my uncles and continued our constructiong process.
My questions are
1 Will my uncle able to stop our work
2 What can we do when they file any suit against us are we liable to pay full amount present market value or the value we registered in 2009 or the remaining Rs 50000 with interest.
3 GPOA is still active, they have not cancelled it and both our uncles are still alive and the GPOA is a registered one and we have done the sale deed on June 2009 almost 3 years back, is this valid
4 The sale agreement was done in a Rs 20 stamp paper with witnesses but not registered will this be useful for us
5 Is there any way to take the possesion of ours from the house by them
6 Presently we are not in the property as the construction is in process, but we have Ration card, Pan card, Voters ID, Patta etc in our name, is there any probability to vocate us.
