Say without affidavit

Dear Friends,

 

I am fighing a land case against my cousin.

 

Does a statement which is filed in a say without an affidavit which is in the nature of a simple denial to the plaints statement, constitute a perjury u/s 340 CRPC?

 

Kindly, clarify.

It depende up ont the fact of case since we don't know the fact of case how could we guess it?

If you are saying you denied only allegations. that does not comes under perjury but need more details to suggest properly.

In civil cases every application and reply must be supported by affidavit

Is no say. Affidavit is a must. Or else u won't get relief.

The same is not an act constituting perjury because the said facts were not on oath. Even otherwise denial of a fact is basically a call upon the other side to adduce proof of the same and not pertaining to averring he negation of the saame
