Seeking legal opinion

I am seeking legal opinion on the case below.

I am a resident of TULJA Society, Paud Road, Pune. I have relinquished Chairman's office few months ago. When I was Chairman I started cleaning and development of what can resemble to a garden in front of the building only because I could not bear to see garbage being dumped in front of our building. This area is a part of a proposed public garden (Sant Dnyaneshwar Udyan) in front of our building.  I was convinced that as a responsible citizen and a member of the society at large it is everyone’s responsibility to ensure that cleanliness be maintained within and without; be it one’s own home, building or surrounding environment. I decided to put in my time, energy and effort in cleaning the area and planting some plants till the time that garden development PMC gets under way. And since I started this, incidences of garbage bags being thrown in have almost been eliminated. This also has greatly reduced the risk of gestation, procreation and propagation of mosquitoes, especially those propagating dengue fever. I did it single handedly. I used to water these plants by connecting a tube to a tap inside the society. Now new Chairman and some members object to this and they want me to stop watering the plants.

Respected Sir,

As it is evident that whatever you did was an volunteer act with good intent.  If the new Chairman has any reservation then it is a totally a new issue.  Your stand might be morally good and strong but technically if you do not have any right over the immoveable property you are referring then despite all your good intentions he has a point in refusing you from watering the plants.  You can take back your plants but what ought to be done over the piece of land is a totally different issue. I hope this clarifies your query.

Dear , you have done a good job , even you can seek the help of some NGO as the land is proposed garden  and you can contact the MCD or body making garden and can give proposal that you are interest in developing and planting the tree on the said piece of land . I think they will definately appreciate your work and also can provide you the guidelines for planting the tree. very good keep this spirit up. where there will there is  a way

Dear Sir,

Sub - Allocation of Society Maintt Exp - Reg.

I do stay in Pune. In recent GBM Every Expenses Of Soceity (from PIN TO PLANE, including Capex, Water Expenses) has been EQUALLY shared between all Flat Owners irrespective of Size of Flat & Nature of Expenses. Scan copy been attached for your immediate ref., Society even planning an Borewell & an Temple also & as per OC the same expenses also needs to be shared equally among all flat owners.

I've been thru Net & found various articles, which says the said procedure is wrong. I've even written to them on this & they say, this is been accepted by Poona Federation & is as per Maharashtra CHS Act. I've even used RTI to Registrar seeking the information.

In the mean while, kindly let me know your opinion along with required literature. I've paid Six months payment under Protest as an safe play game.
