We finalised a flat to purchase in a reputed society in bangalore and paid 5 L as the token amount. We also signed a 1 pager MOU and got it franked. The owner lives in US and this was signed with his cousin here who claimed he had the GPA. We later found out the GPA is not registered. However, the bigger problems stated coming in when kept following up for property documents for bank loan. Even after a month of follow up, there was no confirmation, alot of confusion and hence we cancelled the deal to avoid investing in such a property. The MOU said the buyer can cancel the deal if funds cannot be arranged. Now the owner/his brother are not returning our advance. What are my legal options?
