Dear All,

 

Can we send counter to be filed for a Transfer Petition (criminal) via register post (respondetn ti appearing  as Pary-in-person). Do Supreme Court accepts it ...

dear members

yes,  mr.agarwal is right.

as far as i know, you can not send any petitions, counters etc to any court by post. it has to be presented in person.

only exception is that some times some courts accept letters as writ petitions if the matters merit such a treatment.

                                O R D E R


            The respondent has chosen not to appear despite

service    of    notice.       However,      the   respondent      has   sent

counter affidavit through post.

            By the present petition, the petitioner-wife seeks

transfer of Petition No. 940/2006 titled 'Shafique Ahmed

Vs. Shamina Khatoon' pending before the Chief Family Court

at Allahabad to the Court of District Judge, Kalyan, Distt.

Thane, Maharashtra.

            Heard learned counsel for the petitioner.                We have

also perused the averments made in the counter affidavit.

            Having regard to the fact that the petitioner is

living    with      her     parents   at     Kalyan,   Thane       District,

Maharashtra and it is not possible for her to defend the

case at Allahabat and without going into the merits of the

case, we direct that Petition No. 940/2006 titled 'Shafique

Ahmed Vs. Shamina Khatoon' pending before the Chief Family

Court at Allahabad be transferred to the Court of District

Judge,    Kalyan,    Distt.    Thane,      Maharashtra.      The    District
Judge, Kalyan, Distt. Thane may try the case himself or

makeover the same to a court of competent jurisdiction.

         The transferee court shall soon on communication of

this order transfer records of Petition No. 940/2006 titled

'Shafique   Ahmed   Vs.   Shamina   Khatoon'   to   the   transferee

court.

         Transfer petition is allowed.         No order as to the

costs.

I stand corrected. I do not know whether it can be quoted as a precedent by other litigants, particularly women.
