Society law

i stay in co operative society with 350 member. ground + one. most of the ground flat owner made an extension and built un authorised extra room. i want to know whether following is illegal construction?

1) fencing to the flat by ground floor owner.

2) extending  otaa in front of flat.

secondly  does the member made this type of illegal construction can be disqualified for society election? does i  can apply to subregistrar or else where?

Mr. Shekar,

 

Strictly speaking as per law, making alterations to the existing sanctioned plan is illegal. however, it is order of the day, becoz of vaastu and some other reasons, we do make alterations in the flats, however, it is must to seek permission of the society for making such alterations to the existing structures and if major members of the society agree and willing to go ahead with such alterations then you cant challenge unless it is specifically  prohibited under the bye-laws of the society.
