Status Quo and Contempt Proceedings

Hi,

Plantiff have filed a appeal in high court against us (as defendent) regarding a property case dispute decreed in favour of us(defendent). Along with appeal, plantiff has filed a Stay order application as well.

Further After almost a year of appeal, platiff alledges construction of an area in property by sending us contempt notice. We then (after an year) came to know that the judge has also granted status quo order on the appeal.

1. At present the case is still in defect, How can judge pass an status quo order without hearing the defendent? Presently case has not even come to court of hearing.

2. We have not received any status quo order nor the same have marked in main High court file? How can be object & challenge the same?

3. Can court grant status quo with hearing plantiff and even without passing stay order?

3. Please advice on contempt notice and to counter it.
