Sub division wrong

We purchased a land with 1589 sq feet and we got patta vacant land tax and plan approval after we start construction and It is under process. Meanwhile we got call from seller that there is error in subdivision no, it is wrongly entered as 39 instead of 37, the problem is we already got VLT, Plan approval etc for that wrong subdivision no 39, also in patta it's mentioned area 1.45 sqm instead of 1.48 sqm which is mentioned in document, already we done one rectification in document. Now again we are in a situation to rectify the sub division, how could we rectify the sub division and also the area pls advice

The vendor has erronously shown sub-division No 39 in the Sale Deed, which is (actually) 37, means all records pertain to the land which is not available with the vendor for sale. Accordingly it is found VLT, plan development sanction and construction action(s) taken by vendee (you) pertain to the land which pertained to "some other" titleholder. Therefore, you will have to get records / actions rectified to the land under sub-division 37.

It would be appropriate to show relevant documents to a local prudent lawyer for appreciation of facts, professional advise and necessary proceeding.

Yes, this appears to be an error in the sale deed and not in the revenue records.

Hence you may have to verify the revenue records and go for rectification deed accordingly to rectify the errors wherever one occurred.

Thank you sir, actually we got patta for the wrong subdivision ie 39, in that the area mentioned for 1.28 ares instead of 1.47ares, from this only we came to know about wrong subdivision, my confusion is whether subdivision change is enough in only document or in all other documents like VLT, PLAN APPROVAL etc. we don't know the procedure sir  pls help. Once again thank you

The wrong subdivision number has to be rectified  in all the property related documents and  ensure it is done correctly to avoid future complications

It is advisable to seek professional services of a local prudent lawyer to protect your interest / property.
