in case of a prelimnary decree passed by a district court in pune for a partition suit against a defendant who is currently residing with additional structures built and in the forced posession of the property that is still joint in nature, how will the take over of the plaintiff share happen if sale is not an option. is it require for the party to wait until the final decree is reeived or until the advocate commisioenr report is submitted? also, is the need of a police required to take possession of the property.
how can the plaintiff execute this without inviting any criminal complaints in taking the possession .
