Taxability of medical reimbursement under section 3a

My son underwent open heart surgery in 2007 at the then Narayan Hurudayalaya, Banglore, for which I received medical reimbursement from my employer in 2013 (in maharashtra) of Rs. 53,000/- (against actual bill of Rs. 1,20,000/- ). Employer deducted tax on this amount excess of 15,000/- .i.e. tax on 38,000/-. Is this amount taxable? May I get any rebate under section 3A. How will I know that the said hospital is approved by IT chief commissioner for said rule (3A)? or any other rule under which I can claim rebate? Thanks.
