Tender breach

Hello ,

We have accepted a Tender from state govt. and have completed the job in July 2014. The tender said that the payment shall be made in 1 month of the job completion. its been more than 6 months and still we haven't received the payments. I see that this is a breach of Tender agreement. Can you please advise how the pending payments can be received. We have invested heavily and undergoing losses as the Bank is charging interests etc. We are in deep trouble. Can some one provide me a viable solution. We have made several attempts but they have advised that payments are not available. Please advise

You need to first see what are the legal rights availble in the tender to resolve the dispute? Like Arbitration, Court Case? You need to engage the lawyer and serve the legal notice to the concerned government department.

Refer the matter to arbitration and also claim interest and penalty beyond the stipulated date of payment of the contract amount.
