Writing a date on a cheque by the payee to encash

Page no : 2

{Balu manikantan} SUBRAMANYAM (Practising Advocate)     23 September 2016

Thanks all when Iam asking will it amounts to material alteration or not then the reason behind it is whether the cheque Can be used for suing under 138 ni act if it is bounced. As few judgements say that the consent is required to put a date as per the payer choice and few judgements say the consent is not required as when the cheque is given without date then the consent is given to payee to put the date of payees choice. Regards Subramanyam

You are yet to share with us as to what is the real issue!

But let us appreciate Mr.Stanley, as he has given a Blog, that can be preserved for all cases as a ready reference for Sec.138 /cheque bounce case.  We find very less persons that takes so much pains to give such elaborate and exhaustive reply.   Some queriests do not present facts and only post a part of the query, that results further queries as post is ambiguous and thus, this type of  elaborate explanation gives no more chance to seek further queries.
