Aiims leave issue

My wife is a permanent employee of All India Institute od Medical Sciences (AIIMS) as a doctor. I came to USA from my company on an assignment. She didn't join me at that time. After few months, she applied for a leave of 3 months to come over to USA to visit me as I was not well. She applied for a leave and she was granted a leave of 3 months. AIIMS authorities got a surety BOND (Rs. 3 lacs) signed from her that she won't extend her leave, she would join after three months and she wont resign for 2 years after joining the duty.

 

She had to stay in USA for 10 months because of my health, her health problems and taking care of our 3 yrs old child. She submitted application for extension of leave 4-5 times. Each time they rejected the application.

 

Finally, they sent a memo telling that they are going to hold an inquiry against her under Rule 14 of Central Civil Sevices. She returned back to India on receipt of this memo and joined back the duty.

 

I've couple of questions:

1) Can a govt. institution legally get a surety bond signed from employee when employee is visiting abroad on personal expenses and no training/education or any investment is done by government at that time?

2) Would this bond stand binding on her since she didn't join the service in 3 months?
