Appeal in s.125 crpc

Dear members,

petition u/s.125 crpc was allowed and the judicial magistrate passed orders directing the respondent to pay Rs.2000 to the petitioner every month. Under what provision appeal has to be filed in the district court against the order of the magistrate?please send me the appeal format?It is very urgent.........please help me members

Dear Kartik

You can file a petition of appeal before the District Judge, to which the trial court magistrate is subordinate to him. There is no specific format. You can approach a local lawyer who based on your ground of appeal will prepare an appeal petition.

No Appeal lies from the order under section 125 CrPc as there is no conviction against the husband as an accused. But Revision lies under section 399 of the CrPc before the Sesion Court.

THE VIEW EXPRESSED BY  MR. ASSUMI IS CORRECT. ONLY REVISION LIES EITHER TO SESSIONS COURT OR HIGH COURT CONCERNED, AGAINST THE ORDER OF MAINTENANCE GRANTED  U/S 125 CrPC.

Is it section 399 or section 397 of CrPC for filing Revision against the Maintenanace Order????
