Call center issue

Hi

I joind hands with a business person in the city to run a international call center.  We had about 30 employees and the show was runnung for just 2 months.  I was designated as hthe head of production.  SInce the payment from the overseas client was not made we had to stop the show and we were not able to pay the employees for the 2 months worked.

Now recently the employees have filed a compained against me at the labour department for not providing them the salary and there was no proper offer letters issued to anyone, moreover the company's R.C is on a different persons name who provided us the space to run the business.  I have not signed a single document with anyone.  The terms between the owner of the company and me were just on words that we would share the profit on 70& 30 basis but no papers.  How do i go about it as i am not in a position to pay the out statnding, will the owner of the company stand responsible as he holds the R.C of the company????

If you have not executed any agreement nor they have any document with your signature then what is your legal binding to the company ?

The complaint is filed by all employees.

By which right you were overseeing, managing, supervising on day to day basis.

Why no offer/appointment letter was issued and all lawful obligations were not fulfilled?

Someone shall have to pay the wages. It is better to pay the wages and peruse the owner (on papers) to close the matter.

The employees who have filed one complaint can open multiple fronts.

You may treat this episode as a learning exercise and be careful in future. A sensible business person shall arrange at least one year expenses in advance, make arrangements for reaching breakeven, before initiating the enterprise.
