Cheque enchashment by pa holder

Hello Learned Advocates:

I had given a bearer cheque to a firm "ABC & Co" The cheque was en-cashed by PA Holder [Mr. John] who is the son of one of the Partners and other partners in the firm are his [PA Holders] brothers.

The Cheque given by ABC & Co to me has bounced. I'd like to know if I can make the PA Holder who has en-cashed the cheque as a Respondent Party in the case or not ?

I only have certified documents of him [Mr. John] signing as PA Holder in Government Contracts to support my claim and no original POA. Kindly let me know if I can make Mr. John as a Respondent in the Case.

The Power of attorney holder cannot be held liable for the legally liable debt, only the company can be held, file a suit against the MD of the company.
