Cheque is receeived as a security with time binding

Dear expert friends, your exert advices really encourage me to learn something new everytime and give me the right direction for my cases. Thank you so much all of you.

My client received a cheque from the accused on 30/072013 as a security till the date on cheque mentioned by accused as 01/10/2014. My client deposited the said cheque for clearing as on 01/10/2014. I want to prove in the court that its not for security after 01/10/2014. How can I mention ? Can i get some citations ?

The bank will see the cheque whether it could be honoured or not basing on the rules for honouring the cheque.It will not go whether it is for pledging or surity etc.If the cheque is bounced they endorse it to you with reasons for not honouring like "no sufficient funds".Instructions to return etc.Then it is your lookout to go for justice duly filing a case in the proper court.
