The issuer has valid reason for dishonour of cheque.

Agree with Vishal. As dishonour is by the force of Law and not by the drawer.

No,you can not initiate proceedings u/s 138 of N.I.Act against drawer when cheque returns due to attachment /freeze of account by Income Tax Department.
