Consumer Protection for Private Limited Company

Hi everyone,

Can any one give a expert opinion on this.

In a consumer complaint, where the complainant, a private limited company rep by its driector, buys a car for his personal use from a a reputed car manufaturer, spending around 94,00,000/- and proves to be a faulty vehicle and there is deficiency in service.

Now, when a complaint is filed in the state commission, the file is returned on grounds that, a private limited company is not liable for compensation under the CP act 1986 and asked to appoach the civil courts.

Is this the remedy ? or are there any case laws for this kind of situation. The vehicle is brought for personal use and not commercial. can t this complaint come under the purview of the CP act ?.
