Contact employment

Dear Madam/sir,

We are some thirty employees are working in a govt. project as contact emplyees for last 8 years. Last 2 years we are continuing in service without single break day. Now our employer has served a notice of termination and appointment letter for 89 days. we think the employer wants to terminate us in next time and hire another people in our place.  Now the project has been extened for another terms of  5 years.  can't  we continue as lont the project runs?.if we approch the court  will any law go in our favour?

1. have you any contract note when joining.

2. ESI, PF details. If any.

3. If you are working in last 8 years- and not get any leave from last 2 years. Than he cant terminate you from service without giving any sufficient reason.

there is no sufficient reason in this case.

Next term five years extended- its mean there is no problem regarding employment.

If you are working honestly/hard working -your employer has no right to terminate you witout any sufficient reason and appointment to another employee.

Thank you Mr. Prajapati ji,

i have only one joining letter that was for only six months. After that the employer has never given any appointment letter only extention on 89 days basis. Earlier they were giving a break day but last two years we do not get any break day or any salary cut. we have no ESI, PF details only a consolidated amount. unfortunately the employer, we think is planing to bring his own people into the service and therefore has served termination letter alongwith joining letter for 89 days to all the 30 employees. we think the employer wants to advartise the post and  bring his own people. otherwise why the termination letter? perhaps he wants to break our service. No doubt that we are working honestlyand  have got memento and appreciation letter etc. but this present boos has another plan in mind. he is not happy with us.  though the project has got extention we do not think he will continue us anymore. can any law give us any protection? at least a stay or any order for continuation of service till the project runs?
