Cordless phone - purchase issue

Sir, I bought a cordless phone worth around 4k from a store in chennai. when i bought it i made sure with the guy at the store that the phone has a conference call option in it and he did assured that it has it and it was even mentioned on the phone box package.i didnt suspect any tampering on the box either. but after purchasing it ,and when i tried to use the conference call option, i noticed from the manual book that the conference call facility is not available specifically in this model.now the store keeper doesnt want to take the phone back as the package is opened. am totally frustrated and feel cheated on this.it is infact from a branded phone company.i want to approach consumer court for this.who should i file the case on ,is it on the store or the phone brand company. ?also, i work abroad and visit india once in 6 months.if i file a consumer court case, can i ask the court to give me a update on email and also accept my replies by email as i wont be able to come for in person appearance neither do i can rely on anyone to be my representative to go to court.
