Creation of Retirement Benefits out of Gratuity

Dear Friends,

As we know that according to the Payment of Gratuity Act the highest amount payable to an employee is Rs. 3,50,000/- based on the last drawn basic and the years of service. But many a times in time of retirment we find that the amount to be payed exceeds the normal permissable level. As for our company Gratuity is part of our salary we find that in time of retirment we a losing a lot of amount which we could have recieved. It there any retirement benefit scheme which could be created which will compensate this loss and how do we create it. What are the legal obligation involved in it. Can you all suggest and help
